Chapter 7 Bankruptcy

Chapter 7 bankruptcy, also known as a “straight” or “fresh start” bankruptcy, is usually a quick proceeding (three to six months) that allows you to discharge most debts and get an immediate fresh financial start. Some people believe the court will take everything they own when they file bankruptcy. This is not true. There are generous exemptions that cover many assets that an average person owns (e.g., house, car, household goods, retirement accounts). If there is a chance you have an asset that may not be exempt, you may still have the option to file a Chapter 13 bankruptcy (see below) and retain your assets. Chapter 11 Bankruptcy

Chapter 11 bankruptcy is a good option for small businesses and larger corporations struggling with more debt than they can afford. This form of bankruptcy offers several advantages. It is a chance for you and your partners to come up with a reorganization plan that will increase your profitability, and negotiate reasonable payment plans with your creditors. Chapter 13 Bankruptcy

Chapter 13 bankruptcy allows you to propose a plan to repay some of your debts over three to five years. Chapter 13 is ideal when you want to keep your house or car, but you are behind on your payments. Chapter 13 bankruptcy is also a good alternative when you do not qualify for Chapter 7 bankruptcy relief.
